RELEASE, HOLD HARMLESS

&

INDEMNIFICATION AGREEMENT

In exchange for the right to hunt on the property of Santa Margarita Ranch (hereafter referred to as "Land Possessor"), located at S Sasabe Hwy, Tucson, AZ 85736, the undersigned Participant agrees to the following:

1. Release of Claims

Participant, on behalf of himself/herself and his/her executors, administrators, assignees, or heirs, hereby waives any and all rights and claims for damages, losses, demands, or actions whatsoever—whether known or unknown—against the Land Possessor and any of their heirs, employees, directors, officers, or agents. This includes, but is not limited to, any and all injuries, damages, or illnesses suffered by the Participant or to the Participant’s property, which may arise out of or be in any way connected with:

• Hunting activities,

• The discharge of firearms,

• The firing of live ammunition, or

• The Participant’s general presence on the property.

  
  

2. Assumption of Risk

Participant expressly assumes all risks associated with entering the Land Possessor’s property and participating in hunting-related activities. These risks include, but are not limited to, the handling and discharge of firearms, and any hazards inherent to outdoor and hunting environments.

3. Indemnification

Participant agrees to indemnify, hold harmless, and defend the Land Possessor and any of their heirs, employees, directors, officers, or agents from any and all:

• Fault,

• Liabilities,

• Costs,

• Expenses,

• Claims,

• Demands, or

• Lawsuits

arising out of, related to, or connected with the Participant’s presence on the land or participation in hunting-related activities.

If any such claim or lawsuit is asserted—whether under federal or state law, or any legal or equitable theory—Participant will cover all costs, including attorney's fees, court costs, settlements, or judgments rendered against the Land Possessor and their affiliates, whether individually or jointly with the Participant.

4. Acknowledgment

Participant confirms that he/she has read, understands, and agrees to abide by this agreement. This document shall be binding upon the Participant and his or her executors, administrators, assignees, or heirs
